Terms

These Terms set out the rules for using Spoon, our home food inventory app, and the pineberg.studio website (together, the "Services"). By creating an account, installing the app, or using the Services, you agree to these Terms.

If you do not agree to these Terms, please do not use the Services.

1. Who we are

Spoon and pineberg.studio are operated by Pineberg Studio Ltd ("Pineberg Studio", "we", "us", "our"), a company registered in the United Kingdom.

2. Who can use Spoon

Spoon is intended for individuals and small organisations (for example, households and small businesses) who want to keep track of food inventories and expiry dates.

You are responsible for ensuring that you have the right to use the Services in your country and that you are able to enter into these Terms (or have a parent or guardian do so on your behalf where required by local law).

3. Your account

To use Spoon, you may need to create an account.

  • Keep your account details (including your password, if you use email and password) secure and do not share them with others.
  • You are responsible for all activity that takes place under your account.
  • You should tell us promptly if you think your account has been compromised.

4. Subscriptions, trials, and billing

Spoon may be available as a one-off purchase with an optional subscription for additional features (for example, voice entry).

  • All purchases and subscriptions are processed by Apple through the App Store. Apple acts as the merchant of record. We do not see or store your payment card details.
  • If a free trial is offered, you will be told the length of the trial before you start. Unless you cancel before the end of the trial, your subscription may automatically convert into a paid subscription and renew at the interval shown in the App Store.
  • You can manage or cancel your subscription at any time via your Apple ID account settings. Deleting the app does not cancel your subscription.
  • Prices for Spoon or any subscription may change in the future. If this happens, Apple or we will normally notify you in advance as required by the App Store rules.
  • Any refunds are handled according to Apple's policies and are at Apple's discretion.

5. Acceptable use

You agree that you will not:

  • use Spoon for any unlawful purpose or in connection with any unlawful activity;
  • attempt to access accounts or data that do not belong to you;
  • copy, modify, reverse engineer, or decompile any part of the app or Services except where permitted by law;
  • use automated tools (such as scraping or bulk data extraction) to access the Services, except through any documented API we explicitly provide;
  • upload harmful content (for example, malware) or attempt to interfere with the operation of the Services.

6. Your content

You retain ownership of the data you store in Spoon (for example, your inventories, item names, expiry dates, and feedback).

You grant Pineberg Studio a limited, worldwide, non‑exclusive, royalty‑free licence to store, process, and display that content solely for the purpose of providing and improving the Services.

7. Our intellectual property

Spoon, the pineberg.studio website, and all related content and branding (other than your own content) are owned by Pineberg Studio or our licensors and are protected by copyright and other laws.

We grant you a personal, limited, non‑transferable, revocable licence to use the app and Services in accordance with these Terms. You may not use our name or branding in a way that suggests endorsement or partnership without our prior written consent.

8. Availability and support

We design Spoon to be reliable and simple. However, the Services may occasionally be unavailable due to maintenance, technical issues, or factors outside our control.

  • We aim for at least 95% uptime over time, but we do not guarantee uninterrupted availability.
  • If you need help, you can contact us at support@pineberg.studio. We aim (but do not guarantee) to respond within 24 hours, excluding weekends and public holidays.

9. Food safety

Spoon is a tool to help you keep track of what you have and when it is due to expire. It does not provide food safety advice, and it does not replace your own judgment or official guidance.

You are responsible for deciding whether food is safe to eat. We are not responsible for any decisions you make about consuming or discarding food, even if those decisions are based on information stored in Spoon.

10. Privacy

Our Privacy Policy explains how we collect, use, and protect your personal data when you use the Services. Please read it carefully. By using Spoon, you acknowledge that we will handle your data in line with that policy.

11. Third‑party services

We rely on certain third‑party services to provide Spoon, including Supabase for data storage and Apple for sign‑in, subscriptions, and push notifications. These services have their own terms and privacy policies, which may apply to you in addition to these Terms.

We are not responsible for third‑party services that we do not control, but we aim to work only with reputable providers and to keep the overall system simple.

12. Our responsibility to you

Nothing in these Terms excludes or limits our liability where that would be unlawful, for example for death or personal injury caused by our negligence, or for fraud.

Subject to that, and to the maximum extent permitted by law, we are not liable for:

  • loss of profits, revenue, business, or anticipated savings;
  • loss or corruption of data (except to the extent we fail to take reasonable steps to protect it);
  • indirect or consequential losses of any kind; or
  • any loss arising from your use of Spoon to make decisions about food safety.

In any case, our total liability arising out of or relating to the Services and these Terms is limited to the greater of (a) the amount you have paid to us for Spoon in the 12 months before the event giving rise to the claim, and (b) £25, except where the law does not allow such a limitation.

13. Ending or suspending your access

You can stop using Spoon at any time and can request deletion of your account by contacting us.

We may suspend or terminate your access to the Services (or part of them) if:

  • you seriously or repeatedly breach these Terms;
  • we are required to do so by law or by one of our service providers (for example, Apple); or
  • we decide to discontinue Spoon after giving you reasonable notice.

14. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes in the app, our providers, or applicable law. When we make changes, we will update the "Last updated" date at the top of this page.

If we make material changes, we may also provide a notice within the app (for example, a prompt on login). If you continue to use the Services after the updated Terms take effect, you will be deemed to have accepted them.

15. Governing law and disputes

These Terms, and any dispute or claim arising out of or in connection with them or the Services, are governed by the laws of the United Kingdom, without regard to its conflict of law rules.

The courts of the United Kingdom will have non‑exclusive jurisdiction over any such dispute or claim. This means you may also have the right to bring proceedings in your local courts where consumer law allows it.
